Establishment

[edit]

It's not clear when the RAIU was established. The Railway Safety Act 2005, section 55, dated 18 December 2005, states

There shall be established a unit within the Commission which shall form part of the Commission and which, subject to section 57, shall carry out its functions independent from the other functions of the Commission, to be known as the Railway Incident Investigation Unit

But Section 4(1) of S.I. No. 258/2014, dated 12 June 2014, states:

The Minister shall, from the appointed day, ensure that an investigating body, to be known as the Railway Accident Investigation Unit ... is established in the Department of Transport, Tourism and Sport to carry out the function of investigating accidents and incidents in accordance with these Regulations.

and "appointed day" is defined in section 2 as

the day appointed under Regulation 4(11) as the day on which the Railway Accident Investigation Unit is established

Section 4(11) states:

The Minister shall by notice, published in Iris Oifigiúil and on the website of the Department, appoint a day (“appointed day”) on which the Railway Accident Investigation Unit is established under this Regulation.

The relevant notice may be found at Iris Oifigiúil for 24 June 2014, and it shows 1 July 2014.

From this it appears that the name Railway Accident Investigation Unit has been used by two bodies, one of which is the successor to the other. So we need to describe two dates: (i) the date when the original RAIU was established, presumably in 2006; and (ii) the date when the second RAIU took over the duties of the first, i.e. 1 July 2014. --Redrose64 🌹 (talk) 12:39, 24 May 2025 (UTC)[reply]
