Request to Clarify AG Letitia James’ Authority in Cuomo Investigation

[edit]

Hello,

I am requesting an edit to clarify a misleading statement regarding Attorney General Letitia James’ role in the sexual harassment investigation of Andrew Cuomo.

Issue with Current Text

The page currently states that “Attorney General Letitia James declined to press criminal charges against Cuomo.” However, this wording is misleading because it suggests that she had the authority to do so. Under New York law, the Attorney General cannot unilaterally file criminal charges without a referral from the governor or a state agency, which she did not have in this case.

Proposed Edit

Replace:Attorney General Letitia James declined to press criminal charges against Cuomo.

With:Attorney General Letitia James did not file criminal charges against Cuomo, as her authority was limited to conducting a civil investigation. Under New York law, the Attorney General cannot initiate criminal charges without a referral from the governor or a state agency. Instead, the findings were referred to local district attorneys, who had the jurisdiction to determine whether criminal charges should be pursued.

Supporting Sources:

1. NY1: New York law prevented AG James from criminally charging Cuomo

2. NBC New York: Why criminal charges were never filed against Andrew Cuomo

3. PBS NewsHour: Judge dismisses criminal charge against Andrew Cuomo

This edit ensures accuracy and prevents misunderstandings about AG James’ legal authority in this case. I appreciate your consideration of this request.

Thank you! Poliphil24 (talk) 21:50, 2 March 2025 (UTC)[reply]

Remove text erroneously stating that the FBI "declined to investigate further" Cuomo's shielding nursing home donors from lawsuits

[edit]

Change "On March 19, 2021, the FBI reported that an investigation was underway on Governor Andrew Cuomo for improperly using the power of his office to shield nursing home executive political donors from COVID-19 lawsuits but declined to investigate further.[285]" to "On March 19, 2021, the FBI reported that an investigation was underway on Governor Andrew Cuomo for improperly using the power of his office to shield nursing home executive political donors from COVID-19 lawsuits.[285]"

The citation does not mention anything about the FBI stopping the investigation or declining to investigate - in fact the article's title is "FBI reportedly investigating Cuomo role in shielding donors from Covid liability".

The text "declined" may be a mistake related to the article paragraph regarding the Guardian seeking comments on the matter: "The Guardian has contacted the New York governor’s office seeking a response to the report of the FBI inquiry. Meanwhile, the City said that the governor’s office and US attorney for New York’s eastern district had both declined comment.". Yyygg99gg (talk) 21:50, 25 May 2025 (UTC)[reply]
