Hitendra Gandhi
[edit]Hitendra Gandhi (born 1989) is an Indian advocate and public interest litigator based in Mumbai, Maharashtra. He is known for representing petitioners in several high-profile cases concerning constitutional rights, environmental protection, election transparency, housing and slum rehabilitation, and police accountability.
Early life and education
[edit]Gandhi was born in Mumbai in 1989 to Devichand and Shanti Gandhi. He completed his schooling at Our Lady of High School and earned his law degree from Vivekanand Law College, Mumbai.
Legal career
[edit]Gandhi has represented petitioners in numerous public interest litigations filed before the Bombay High Court, focusing on fundamental rights violations, civic neglect, housing displacement, and alleged state misconduct.
In 2022, Gandhi appeared as the petitioners' advocate in a case challenging the constitutional validity of the Unlawful Activities (Prevention) Act (UAPA) and the sedition law, citing concerns over their misuse and infringement of civil liberties.[1]
In another matter, Gandhi represented the petitioners in a plea raising concerns about alleged discrepancies during the final minutes of polling in the Maharashtra Assembly elections.[2]
Gandhi has also taken up cases involving slum demolition and housing rights. In one instance, he assisted a student who was unable to appear for an examination due to the alleged denial of a police escort after trying to stop the demolition of his family’s home.[3]
In 2023, Gandhi represented the family of Somnath Suryawanshi, a man who allegedly died in police custody in Parbhani, Maharashtra. Gandhi petitioned the court for a court-monitored investigation into the custodial death and raised concerns over a prejudiced inquiry. The Bombay High Court later criticised the police for conducting a “preconceived” investigation.[4][5]
Gandhi has filed complaints before the Maharashtra State Human Rights Commission (SHRC) in matters involving civic neglect and unlawful evictions. These include the case of garbage mismanagement near the Harbour Line railway and the illegal eviction of 30 families in Charkop.[6][7]
Advocacy and public engagement
[edit]Gandhi is actively engaged in civic and constitutional advocacy, raising legal concerns over bureaucratic apathy, poor governance, and violations of rights affecting slum dwellers, minorities, and marginalised communities.
